Normally this time of year you can open windows. I have very bad allergies and even with my meds I am uncomfortable. The A/C froze up this weekend and I defrosted it, I belive it just needs a little shot of freon. Not expensive, but the Landlord will not cooperate. I have called 4 times which I have noted. It is his responsibility. Can I just deduction the amount of the bill from my rent? Should I ask for remibursement? Can I make him pay for a lost day off to wait for the service man?

he has to authorize the repair. you cannot call a repair man to work on the properties mechanicals with out the landlords go ahead. He owns them, not you. If you had a triple net lease then you could call the repair man yourself. If you fix it, you cannot deduct it or bill him for it. You will eat the repair bill.

Not many states allow you to "repair and deduct". Check your local statutes before hand or you may find yourself evicted. Also, unless it's specified in your lease that the landlord is responsible for the repairs of the a/c...then you may be out of luck altogether. And NO...you can't make him pay for a lost day of work.

Ironically, if you send your landlord a letter by certified mail with return receipt, here in the U.S.A., stating exactly what the problem is? They will normally take care of this problem immediately. An attorney could possibly explain the reason why?

don't deduct the amount from your rent. this will give him cause to take you to small claims of evict you. instead, if it's worth it to you, take the landlord to small claims.

Get it repaired and then send him the bill. If he refuses to pay the bill, deduct it from your rent. he can't kick you out, because he should have fixed it himself or paid the bill.
