I don't know if I should say something to the boss because I love my job and don't want to lose it...but below minimum wage is illegal, not to mention is kind of cutting my wallet into pieces.

Complain if you like...but you are not by law required to be paid minimum wage in a profession that generates gratuities, unless they do not bring you up to minimum wage.

I used to make waitressing awhile back 2.50 hourly+ tips and bartending 20.00 a shift+ tips and that was Manhattan NY. Tips are to be considered, in fact you are to even file that at tax time, which makes me believe you do not declare your tips. Tips put you well above minimum wage and newsflash you are making the same, if not more hourly than other parts of the country doing what you do.
You say cutting your wallet? You must work at a real crappy place or you stink at waitressing, I used to make depending on the day $250-300 a day.

In a nut shell - no.
There are numerous job positions that don't fall under the minimum wage laws - restaurant workers who receive tips, farm workers in general, some "per piece" or flat rate workers and so on.

It's been this way for servers for a long time because restaurant and bar owners know the customers will make up the wage. No, it's not fair and it takes advantage of the clientele and the employee, but if you want to be in that line of work, you'll have to accept it.

Restaurant workers were at one time exempted from the minimum wage, tips were to be figured in... they had a lower rate... I don't know for sure if this is still true

If you get tips they are allowed to pay under minimum wage. If you agreed to work for this amount then you have nothing to complain about.

you should be filling in a tip declaration each week. The employer uses that to set your pay for that week and your pay + tips must be minimum wage or above .

It doesn't matter what tips you make that is above what you are suppossed to make in min. wage. If they are paying below the state or federal wage(state wages supercedes federal wages) then they are in for world of hurt and lawsuits.

They can do that if your making tips. I worked at a resturant and made like 2.50/hour.
