I've been here all of 2 wks & have NO idea WTH's the problem. Paid $1660 & moved into an apt on 9/7 (rent is $600/mth so paid $600 sec dep, $460 prorated Sept rent, $600 last mth rent) A wk after I moved in, I rec'd a mailed copy of my lease, looked ev'thing over, appeared OK. On 9/15, I rec'd a statement from Property Mgmt saying that I need to pay the $600 for Oct rent to avoid more late fees & possible legal action. Yesterday, in the sliding door, I found a 3-day notice (left 9/21) to leave premises, in essence saying that I am to leave on/before 9/25 for non-payment of rent for Oct. 1. So of course, I pull out the lease again to see if there's ANYTHING on it stating that I still owed $600 for rent for next month. THAT's when I noticed they applied the $600 last mth's rent to AUG (as in..LAST MTH, but that's not right, is it?? ) I didn't even sign the lease til 8/25, so why charge me full PREV month. Also, the statement has my apt # as 80B, but it's 78. Do I need an attorney?

thanks for your responses; actually, when I first went to the apartment, I was told that 80B would be the one that I'd be assigned..then something came up with those tenants not moving as soon as I wanted to; luckily, this one became available so of course, my 1st thought was that all this is more than likely a mix-up & belongs to the occupants of 80B. There was nothing I could do since I didn't see the notice until late Saturday afternoon, & they're closed until Monday AM. Rest assured, I have the lease as well as the bank printout of my posted check. (I hate missing work, but I'd hate to find myself without a roof over my head even more!) thanks again

Send the management company a certified letter on Monday detailing exactly what you said here, only make it clearer and easier to understand. Like this:

Dear Property Management Company,

I am in receipt of your "3 day notice", left inside my sliding door on September 21, 2007.

Your records are incorrect.

I moved into apartment 78B on September 7th. At that time, I signed a one year lease and paid the following amounts:

$460.00 pro-rated rent for September 2007
$600.00 last months rent to be applied to August 2008
$600.00 security deposit

As per my lease, my October 2007 rent is not due until October 1st, 2007. Please correct your records and send me written confirmation of same.

I think someone is confused. If you have the lease in front of you it should spell out what EVERY penny was for when you paid at move in.

Didn't someone from the rental office go over all this with you, explain it & collect the money? When I figured your prorated rent I came up with $480.00 if you moved in on Sept. 7. It doesn't matter what date you signed your lease. Your lease starts with the day stated on the lease.

HOW can they come after you for OCTOBER rent when OCTOBER isn't here yet? No one would have required Oct. rent to be paid at the time of move in.

I would take the lease & pay the rental office a visit. Make sure your name is on the lease. If it does belong to your neighbor & they upset you & worried you, they should compensate you in some way.

Contact the management company, and see if you received the notice by mistake. You may be able to straighten this out. If not get an attorney. Document everything that is said in conversation with the management company.

Sounds like they put the notice on the wrong door.

Go give it to the guy in 80B.

Get a LAWYER and if you cant afford one get legal aid.
