I am in the military and married. My wife is currently living in another country. I filed all the necessary paperwork to get her here to the U.S. but it has been almost a year now. We have an almost 3 year daughter together and she is here with me. As of late my wife has been ignoring my e-mails, taking all of my paycheck leaving me with almost nothing to take care of our daughter and myself. I am leaving for 6 to 9 months in November and my family has agreed to take care of my daughter for that time period. I can't live like this any more. Does anyone have any suggestions on how I would go about filing for divorce even though my wife lives in another country? Thanks!

Sorry to hear of your trouble. For your legal protection, I would definately get a lawyer. You want to at least have paperwork drafted that includes the division of your assests and the custody of your daughter. I do believe you can file an uncontested divorce and if she is unavailable or does not show up to the hearing then the judge would grant you it (not sure the timeline).

Have you thought about closing your bank account and opening a new one that your wife doesn't have access to? I would first send her an email (which you can use in your divorce proceedings to show that she is unresponsive and that you have been trying to make the marriage work) going over your concerns and for reasons you must open a new bank account. Then go ahead and do it within the week. At least that way you told her and gave her a chance to make a decision to talk to you about something. That way if she ever tries to use it against you in court that you cut her off financially, you can show that you did show correspondence to her of this change.

Good luck. It's not easy, especially when children are involved. Unfortunately it sounds like she hasn't been there for you or your and her daughter anyway.

Why does your wife take all of your money? My husband is in the military as well and he could change where his check is deposited and that would be all you have to do about the money situation. About the divorce, I think all that you would have to do is go to a lawyer and they publish the case in a newspaper, citing her name. I would file on charges of abandonment. After all, she has left you and your daughter penniless and in a different country than her. Whatever you decide, I wish you and your daughter the best. Good luck.

Legally sign custody over to whomever is going to be taking care of her. Also give them a power of attorney over your banking account. This can be done at your legal department. This way your estranged wife can't take all of your money. You can also cut her out of your bank account before you leave. You can set up an allotment for her to a bank account of her choice. This can be done at your disbursing, personnel, or finance office. As for the divorce, you should also contact your legal department for advice. Were you married in another country? If so then it is not accepted in the USA. You will still need a lawyer in order to disolve this issue but there is nothing legal that needs to be done here. Next, get you a new bank account with only your name, and maybe one of your parents (for your daughters use if needed) and tell your wife to take a hike.

See a chaplain for some help in thinking this through. He can refer you to the proper counsel and help you through this. Sounds like mom is not looking after your daughter. You need to do the best job you can under the circumstances to make sure your little girl grows up knowing daddy loves her.
