Is this a crime that someone could be charged with? For example how would the driver of the getaway vehicle be charge in a burglary case? With Burglary or with Parties to Crime?

ok, here's the deal -- the DRIVER of the Car would be charged with Party to the Crime (which carries the same penalty). In Wisconsin, anyone who participates and assists in the crime is as guilty as the person who commits the offense.

Now, in Wisconsin, it is interesting because, for example, in a BURGLARY, you must prove that a person broke into a residence with the intent of stealing property. What happens IF one person breaks in (has no intent to steal), another steals stuff, another drives the getaway car.

In WISCONSIN, all THREE will be charded with Burglary and Burglary PTAC. By charging PTAC, they need only prove that the group of them, put together, have commited all elements of the crime. The District Attorney need not prove that any one person committed all "ELEMENTS" of the crime, but that everyone, put together, has committed all of the elements.

Most sections like that give definitions of terms -- they are not by themself chargeable offenses.

I'd have to look at the text of that section to see how it reads to be sure if that general statement applies.
