What I need to ask about is eviction notices. I let a friend move into my place and now she has her boyfriend staying there I told both of them to get out but before she moved in I wrote up an agreement for her to pay me $600.00 in rent but she only gave me $300 and said she would give me the rest three days later. now I call the cops to get them out and the cops say I have to let them stay and obtain an eviction notice for both of them an give them 30 day because she gave me money. Now she is trying to get me evicted by going to my rental office and tell them that I let her move in and that's against my lease agreement. Could they evict me for this?

if your lease states that you cannot sublease a room then yes, they can evict you for that, but they too will have to go thru the legal process of evicting you, chances are they will give you a notice to cure and possibly a warning, it costs them to evict so if you can go and talk to the management office and explain what happened. she's not paying give her a written 30 day notice to vacate. The cops won't do anything because by law you have to give 30 days notice to vacate if not on a lease and 60 days if she's on a lease. Then go to the courthouse and file eviction paperwork.

Nice friend you got there, next time specify no overnight guests.

Some people seem to be upset with you for no reason and by the way no you are not required to report $300.00 to the IRS for taxes there is exemption below a certain amount and you're under that, don't let someone try and scare you.

Hopefully you filed the eviction but you should also have her served with a 3 day notice of pay or quit just so that you have that on file. Depending on your state your eviction may not hold weight if you didn't hit her with the 3 day notice. Also on all this paperwork make sure you have an independent person serve them. Contact your local sheriff's department about servicing fees.

Boy, have you got problems! Go to the courthouse immediately and file for eviction and make sure both of their names are on it. Give them the 30 day notice. Go to your rental office and explain that you were just doing a friend a favor and it got out of hand and show them the eviction paperwork. Maybe if you have been a good tenant they will even help you, although you will have to shoulder the expense and attend the eviction hearing on your own. Make sure you bring to court all paperwork and the agreement she signed. Good luck.

Yes, they could evict you for that. You do need to give them an official eviction notice. She has 30 days by law to get out. At the same time, if you're evicted, you also get 30 days. Next time, don't break the rules and then you won't have this problem.

Yes, if your lease says you are to be the only tenant, then they could evict you for violating that. After all, you did let her move in with you.

And it depends on your location, but the cops are probably right that you have to give them 30 days eviction notice.

Some friend this person turned out to be!

Start the eviction paperwork on your "friend" and her boyfriend then go talk to your landlord. Explain the circumstances and beg for forgiveness. Depending upon how good a renter you have been and what the market is like for rentals in your area, the landlord may be more understanding. Have a back up plan for where you will go if they do decide to evict you also.

Unfortunate if it is against your lease to sublease or have extra roommates then you have a problem

give them 30 day notice to vacate, then also serve a pay or quit notice, since they have only give you half of the rent

Wow, that's a messed up situation. Sorry you have to go through this.

If your lease specifies that you cannot sub-let (lease out a portion of your rental property yourself), then yes -- you would be in violation of your own lease and could be evicted.

I would talk to a housing lawyer, if I were you.

You bet they can evict you. You can't just go around sub-leasing someone elses property without their permission.

Are you paying income tax on that? You are committing more crimes then your friend.
