MoveOn, like any advertiser, was out to get the best deal on rates it could. The oral representation of a salesperson on an $65,000 deal means nothing in court. If the ad ran on another day, MoveOn would not have been able to complain. It was legally stand by ad. If the salesperson violated the Time's policy, he or she should be fired.

Mine is "FoxNews" is the most recognizable oxymoron in modern America.
Er uh, Fox"News" stated: " The New York Times acknowledged Sunday ..."
But here is the disclaimer at the end of Hoyt's editorial, "His opinions and conclusions are his own."
The only thing the NYT did wrong was not to tell MoveOn.org their advertisement was not GUARANTEED to run Monday. But since there was space available Monday it ran anyway and the warning was moot.
