her landlord has told her she must move out at the end of her lease this week.
she has 5 kids the youngest is 3 years old the oldest is 13 years old.
the youngest has assema and needs medication at night in order to breath in his sleep.
the local council say she is not homeless until she turns up at the homeless shelter with the kids and no where to go.

I'm sure there has to be a period of notice in which the Landlord has to give in writing. Did your daughter try to renew the lease? if not I still don't think the landlord can force her out within 1 week.

Whilst I would expect 'normally' she would be entitled to reasonable notice, if the lease is due to expire and she has not been offered an extension, it's hard to see how how she can claim she hasn't had 6 months (or 1 years) notice ..

She needs to contact her local Council housing departments immediately .. they can advise her if there is anything she can do to stay legally** == Housing Departments are usually experts in this area .. since they will have to house her if she becomes homeless ..

(** I guess she could change the locks and refuse to move out .. the Landlord would have to go to Court and if Scottish law is anything like English, it could take 6 months for the Landlord to get her out ... however I can't see how she would EVER be able to rent another place after that ..)

I'm not sure about scottish law but I can't see how he can only give her one weeks notice as that's not enough time to find somewhere else to rent. Why didn't she renew her lease earlier or was there a reason for the eviction? Did he give her more notice and she just hasn't organised other living arrangements? It's hard to help without more information. I hope someone else can help but I doubt the council are wrong. Why not try the Citizens Advice Bureau?

yes - she knew when the lease was due to run out so she should have been looking for other accommodation
