Of course not. It's ridiculous. It's like being in control of potentially dangerous equipment and being drunk. If you run someone over and kill them. It would be two crimes. One of being reckless and also one of manslaughter.

Here is Wisconsin's law, I'm sure every state has something similar
Intoxication. An intoxicated or a drugged condition of the actor is a defense only if such condition is involuntarily produced and renders the actor incapable of distinguishing between right and wrong in regard to the alleged criminal act at the time the act is committed
In my 16 years of law enforcement, I have never heard of anyone sucessfully arguing this

Personally, I think one should be given an even harsher punishment for the crime if one was drunk or on drugs at the time. It shows that one even went to the extent of pumping artificial courage into one's system before breaking the law. That said, if one can still behave while under the influence of drugs and alcohol, then one should be free to do that.

Actually I think that the law should come down harder on people who are drunk. Everyone knows that the first thing you lose when you drink is your judgement, and knowing that we should guard against putting ourselves in compromising situations when we've been drinking. Being drunk is not an excuse for poor behavior.

Of course not.On one hand you can say that "yes he should get away with it because he didn't know what he was doing" which is right but on the other getting drunk in the first place should be considered a crime if it leads to such activities.

Why do people think drinking is an excuse for doing anything wrong, illegal, or just being rude.
