Okay, so here's the deal. I go into work on friday to pick up my paycheck. I look through the drawer where all the cheques are kept. Just then my friend (who works there and was my mentor) walks up to me and tells me that I had been fired and my boss is withholding my paycheck.

Im wondering how this is at all legal?

He's also kept all my tips that I was supposed to recieve for the 4 months I worked there. (at a small restaurant)
Another co worker was fired as well and my ex-boss isn't even giving him a check apparently.

Please help me out guys, its really important I get this money!

You do not even need a lawyer to start the ball rolling.

If you believe that you have been illegally dismissed, or that your salaries have been unlawfully withheld (as in your case), all you need to do is go to the nearest National Labor Relations Commission (NLRC), particularly the Regional Arbitration Branch (RAB). They have a ready form there, and all you need to do is fill in blanks and check boxes.

That form is your complaint against your ex-employer, and once submitted, your ex-employer will be summoned to see you before the Labor Arbiter. When this happens, there is a very big chance that your case will be settled amicably and you will be paid your salaries and tips.

However, if you are unable to strike a settlement at this stage, you will need a lawyer for the next stages of your case. But most cases I know usually do not get past the settlement stage.

If you have no idea where the NLRC is, check the PLDT directory and look under National Labor Relations Commission. Or ask for Director Assistance. Then call the first NLRC number that comes up and ask where your nearest NLRC office is located.

Is there any orgnaisation that deals with such labour problems in your town? Check out with the Police, and get in touch with them and loadge a complaint. In all welfare states, there should be labor offices and people looking into your problems.

sounds like you need a lawyer, I worked for a hotel for a week before finding out I wasn't getting paid for "training" this is totally different and I would demand my paycheck or tell them my laywer will be giving them a call... threaten if you have to :) slavery is illegial in this country!! contact the better business bureau http://www.bbb.org/ file a complaint

There's some state agency that can help you, but I'm not sure which. Maybe the Dept of Labor. They can demand that you get paid.

CAll your state dept. of workforce development. Someone there will help you out.

you need to contact the labor board. there are laws to protect you from this he can only get away with it if you let him
