I am curious to know the answer to this question; Especially since two people were arrested on Friday, 09-21-07, for hanging two nooses from their red pick-up truck in Alexandria, Virginia.

Okay, this is an extermely hot topic!!!

When are the authorities (local, state or national) going to arrest the individuals who hung three nooses from the tree (which is now extinct) in Jena, LA.?

no, it is not illegal in any sense of the word. people may find it distasteful, but it is still legal to be offended in America. although, possibly not for much longer.

the guys were arrested due to all the tension in that area. there is alot of pressure being put on the cops to keep things under control. they probably will end up being charged with 'disorderly conduct' or nothing at all by the time it is all over with.

Federal laws are distinct from state laws -- and much more limited in their scope.

The activities you describe, if anything, would fall under state laws. And most people misunderstand what a "hate crime" is.

First, there must be a crime -- assault, battery, stalking, harassment, whatever -- a plain old garden variety crime.

In the example above, there may be a claim for harassment or criminal threatening -- maybe, if it can be proven.

Then, the intent (mental state) of that crime needs to be more severe than than normal. Hate crime enhancements are based on a more dangerous mental state -- namely, the desire to target and harm an entire large group of people, rather than the desire to harm a single person.

Hate crimes are a sentence enhancement -- the same way you get a more serious sentence for premeditated and planned attacks, compared to harm caused by accident or by being reckless. In all cases, the mental state of the person could increase the sentence -- but the underlying crime (and harm) needs to have happened first.

And either way -- it would be a state issue, not federal.

Hanging a noose itself is NOT a hate crime. Beating the hell out of someone due to the color of their skin, sexual perferance or religion is a "hate crime". Frankly I think people are way to thinskinned and need to stop trying to find a damn reason to ***** whine and complain. I have a ghost in my front yard hanging from a noose should all the white ppl be offended? Better yet I think a "black student" should walk into the "hangout"(if your not making it up ive not read nothing about this) to show that they are not frightened by this thing hanging. Furthermore what business owner would allow such a thing on their property. Wasnt long ago my best friend (a black woman) applied to the KKK. Told them if they turned her down she'd sue for discrimination! Im surprised loud mouth Al Sharpton wasnt called in the ****** idiot! You want to talk about racist lets talk about AL

As far as Jena goes those Nooses were hung because of pep rally for an upcoming game
against the cowboys
along with signs saying 'hang'em high', 'Hang dem cowboys' and the
like. Also BOTH blacks
and whites were putting thier heads through the nooses in a joking
manner

So I would say that no it is not a hate crime. But 6 people beating someone because of his color is a hate crime.

If blacks do it ...no then it is freedom of speech
If whites do it it seems now to be punishable by a gang beating...if you try and charge the CRIMMINALS..the NAACP marches on you.....
