my girlfriend at the time put a second cell hpne in her name under her name for me as I was in hawaii I moved back to michigan and we ended up breaking up and she wants me to transfer cell over to my name and I really dont want to as I have a better cellphone plan from another company and she says it is my responsibility to transfer or pay her the money to disconnect service. the phone isnt even in my name period, What are my legal standings if any. Heck I could just mail the phone back and not even pay the usuage bill and she would be stuck or could she take me to small claims court even though phone was in her name?

Mail her the phone and if you can live with your choice tell her to have a nice day.
If everything is in her name and she received all billing then she is just a touch naive.
Now you can be considered a CAD for allowing this to have gone to this extreme. She was in Love with you and you have now taken advantage of that situation.
So it really boils down to what are you willing to live with.
She may take you to some form of small claims court but I doubt she really has a leg to stand on legally.

Well your in the right section. "Law and ethics." Instead of the legal question you ask you might do better to brush up on the ethics part.
