My husband and I were having a heated argument and he grabbed my arm and I called 911 and said he slapped my arm I was upset and crying and that is on the 911 call the city is pressing charges against him and I spoke to the city attorney and pleaded to him that a did'nt want to press charges but the city is the ploice arrested him and charged him with assult 4 (dv) I did ask the Judge not to put a restraning order between us and she did'nt but if my husband gets convicted of this charge he wont be able to become a legal resident here as we have been working with an immigration attorney for two year and we are at the last step for this to happen he is a very good husband father and stepfather and I'm not worried that he would ever hurt me I feel I made a big mistake involving the police I thought that they could make him or I leave for the night thats what we needed we are getting counseling for our marriage what can I do I was told if I don't go to court and tesify they have no witness

The prosecutor can continue with the charges whether you agree or not -- that's the nature of a criminal charge.

However, the prosecutor is very unlikely to get a conviction if you are on the stand testifying for your husband, and asking the jury not to find him guilty.

And whoever told you that they would have no witnesses is incorrect -- they can use your phone call tape if you refuse to testify. And that evidence would likely be enough to convict.

You can tell them that you blew it out of porportion - but I doubt it would help since everything seems to be going through the courts already.

But the problem is that women do this a lot - call the cops and then say they don't want the guy taken to jail and it just looks like she's being abused but doesn't want him taken off. Just be honest and tell them why you don't want him to go - because it'll affect his citizenship and it wasn't that serious to you

No one else can help you, but yourselves. You and your husband have to start acting like mature adults, rather than children. Check to determine if he is being charged with a misdemeanor or a felony. If it is a felony, try to get it reduced to a misdemeanor, which is a petty crime and may not affect his status.
