my car was hit from behind at a fast food drive through she hit my car so hard she was stuck underneath my car 1 or 2 days later i went to see a doctor they told me i have back spasm after everything and time past her insurance company paid for my bumper they are also paying my medical bills 1,376,50 now they want to settle pain and suffering 500.00 i refused because i think its a low amount do you think i should receive more im talking to a lawer soon.

What kind of doctor are you seeing? A primary care physician, a chiro or an orthopedic specialist?

You need physical therapy, a good home exercise program, a comprehensive pain management program and an expert opinion. If you are still suffering after a couple of months, you should get a referral to an orthopedic doctor.

$500.00 is a ridiculously low sum. If you really need further treatment, I would recommend hiring an attorney. Otherwise, see if you can get at least $10,000.00 for lost earnings, loss of future earnings (if applicable), paying for future meds (such as occasional orthopedic visits, physical therapy for flare-ups and future prescription meds) and pain and suffering.

Although an attorney will probably take from 33 1/3% - 40% of your award amount, he will also net you a higher sum.

See a lawyer soon. Get a copy of your medical files from your MD and take them to the lawyer. $500 is pretty low for possible spinal damage. However, if the MD didn't find any damage and the spasm were temporary, $500 plus costs may be as good as you can get. The lawyer will have a better idea.

several ways to handle this. First of all you may not feel the full affect of the crash for months. Second thing is to see a doctor and see if they want to do a xray of your neck and back. Wait. If you get an attorney they will send you to their doctors and you will ultimately have to foot the bill for them out of what you end up getting, but if you don't get enough the attorney will have it paid.

My advice is wait, you may have fractured a tooth and do not know it now. Neck pain may take a while. Good stuff for aches is Biofreeze.

Do not settle until you have spoken to a lawyer!!! Your doctor is also needed to give you a time frame on future treatment and healing time. Don't let them pressure you into a premature decision!

You should not settle anything till your doctor releases you back to work -- other than that stay sick... Till you A-ok.. Don't do nothing...with the insurance

Please don't settle yet. It will take time for your back to completely heal. Please do talk with an attorney. The insurance company is trying to get you to sign off before you are ready to do so and you will need legal representation. Best of luck to you.

back injuries are very serious. you may have problems for life 500 is very low.
