Please, I need to have an attorney preferably from the state of Florida answer this question.

My ex owes a lot of back child support over $64,000.00 could she in effect have that also washed away with the rest of the debts she plans on having discharged? My child will be turning 18 yo in two and 1/2 months time, so as you can see he stands to lose a lot of college funds if this is granted. also it is not like she cannot afford to pay this, she just doesn't want to pay the balance now that he is almost an adult.

You can't file bankruptcy on child support.

Child support, spousal support and allimony are all non-dishargeable.

No baby help and taxes is the two issues that's no longer allowed to filed on under financial ruin nor does the time downside ever run out they are going to constantly owe those 2 issues inspite of what they do till they're paid regardless of if the baby is of age they are going to nonetheless owe it.

Child Support debt is not dischargable in bankruptcy. She will still owe the $64,000 whether she declares bankruptcy or not.

Child support payments can never be discharged in bankruptcy. She will still have to pay.
