located in montreal, quebec. but im pretty sure the rules are the same as the US.

i am leaving before my lease is over so i am tranfering over my lease to this girl who i have been talking to over the phone for 2 weeks. i have not met her in person since she lives 7 hours away but i think she's the pefect person to give my apartment to because she's just like me, lifestyle vise. she has done the application, deposit money is ready, and she's ready to move-in.

the apartment janitor who collects the rent and etc. does not like her. he has only spoke with her once over the telephone for 1-2 minutes and is making harsh judgements about her. he has agreed to let her take over the apartment but said that if anything goes wrong with her he is going to kick her out and i am going to have to pay the consequences. does he have to rights to do that to me?

also this is an extra side question. is it nornal to have to pay for transfer papers when you have to transfer a lease?

i've looked through the contract that i signed when i first moved into the apartment it doesn't mention any rules about transfer lease, that's why i'm asking the question

What does your lease say about subletting? That's where to find the answer. If the lease says the apartment manager has to approved the person subletting, then the manager has the right to say no -- although he should have a real reason.

If it says there's a fee for transferring the contract, then you have to pay. However, if the contract is transferred to the new person, I don't see how he can come back on you if the manager later decides to kick out the new person.

Make sure you get some kind of documented sign off that the lease has been transferred and you are no longer responsible.

If she is subletting from you, then you will still be responsible for the rent until the end of your lease, unfortunately.

I've never heard of transfer papers. Check out your city's website or call them about the tenant/landlord rights and responsibilities codes. You may find a loophole.

It depends on if you are sub-letting or assigning the lease. If you are sub-letting, then you will continue to have some or all of the liability that you have in the absense of the sub-lease. If you are transfering the lease, then the lessor is consenting to releasing you from all liabilities. You need to find out which of these applies to understand your future liability.

A nominal transfer fee is not unheard of.

If you can, you may also want to talk to the owner of the property to give him/her a heads up about what is going on.

I don't know about the transfer papers, but if your landlord lets you transfer your lease to another person and they sign a contract you are no longer responsible for anything that happens in that apartment the new person who signed the lease would be responsible.

I'm in Ottawa and as far as I know once you sublet your place you've washed your hands of the place.
How long have you been living there? If it's been more than a year he can't make you sign another lease.
As for the you paying for the papers...I don't know.

well to me the guys seems like an ***. if it is like a 6 mo. lease or something he can't kick her out just because he hates her and no you shouldn't have to take the blame. as for the papers that i am not sure about.
