My divorce was finalized a little more than a year ago and part of the divorce decree included a child support order and a wage garnishment order for my daughter. The child support order was issued by the state of Indiana. Since the order and wage garnishment was ordered my employer has been taking my child support payments out of my check every week so I know that my child support is being paid and has been paid since the order started a year ago. I just received a letter from my state's (not Indiana) child welfare division saying that I owed more than $5,000 in child support and that I should be making payments to them. How can they do this when I have been paying my child support to the state of Indiana where my daughter and the order is at. Any advice would be greatly appreciated.

I would gather your pay stubs showing that the garnishment has been coming out of your paycheck. Also contact the Child Support Enforcement Office that has been receiving and processing your child support. Ask them for a copy of the account showing the payments you have made and the disbursements to your ex-wife. Then contact the child welfare division that sent you the letter and provide them with all the copies showing them that you have been paying.

I don't understand why your payments would go to the child welfare division in your state unless your daughter is receiving aide from your state.

Unfortunately you probably should talk to a lawyer which always costs more money than it is worth. While this should be an easy fix the bureaucracy you will encounter will be hell. In the meantime get the payroll department from your job to give you a notarized copy of the garnishment order and an accounting of all deductions paid to date. If they can give you copies of the canceled checks or electronic receipts of monies paid to Indiana that would really help. In the end you will be fine, this happens all the time. Have you talked to your ex to see if money is being received or is that not possible?

I am sorry you are going through this.

Go to your employer and get a print out of everything they have taken out for child support and the address they send it too.

Write a certified letter to the address your employer give you requesting a print out of all the payments they have received.
Make sure you have date you sent letter, case number or child support number included in the letter. You can probably get all of that from your employer.

I can not say this enough:
DOCUMENT ~ DOCUMENT ~ DOCUMENT everything!!!!!

***If you pay directly to your ex wife then get a file and keep organized records over every child support payment.***
***Keep receipts of everything you buy your children because EVERYTHING you buy can be applied to your child support payment***

In some cases it it better to go through the child support enforcement office because it holds both sides accountable BUT if you ever get behind on a payment they will become the child support payee's enemy and no matter what the x wife is doing will not matter cause THEY WANT THE MONEY.

KEEP GOOD RECORDS on visits, children behaviors, phone calls, money, time spent and not spent together & etc.

Obviously your child hasn't been receiving the support payments if she is getting welfare...I suggest you talk with your lawyer and find out where that money has been going (hopefully you have receipts as proof of payment) Otherwise you're going to have to pay that $5,000 back.

Me and my ex had this same issue. The order is in Florida and he lives in NC. NC sent him a letter like the one that you received. I was able to go online to the state disburcement unit of florida and pull up my payment account (I was lucky that Florida has all this online.) And was able to print where I had been getting the support for the months in question. that along with his pay stubs was able to clear this up.

On your pay stubs does it show how much went out to the state? And can or will your Ex help out? Call your local family div. and they should be able to help, I was told that every state has a online accounting web site that shows each case.

was your ex-wife ever receiving public assistance aka welfare in the state that you live in ? does your ex have a child support order open in more than one state ? or do you have another child that you have been named the father for that you probably forgot about ?? it is one of these 3 . trust me

Contact the collection agency thats been garnishing your wages and see whats going on and hopefully you have kept all your paystubs to date to prove yourself in court if needed. Contact an attorney if needbe

If the order is being enforced via the state's DCSE or the court docket then contact them and characteristic then straighten it out. Or call the organisation that reported you owed the 5, 000, and characteristic your organization deliver them evidence that you're being garnished for the court docket order. call who must be observed as and grant evidence of your funds. this may straighten each little thing out.

talk with whomever does your payroll. get proof of what you have paid. same thing happened to my husband, they were ready to take his butt to jail, luckily, he had reciepts of where he had the money garnished, and the stupid office manager just "forgot" to send it to child support enforcement.
