why cant ISP's track down the company or companies or even the persons responsible for sending them out and sue them?

They can, and do. At the administrative/network levels.

However, just an fyi..when/if you call your ISP tech support, they can't do anything to escalate it. The agents on the phone line end have no power over things such as this.

however lets say Santa Clause sent out a virus,.. that does not mean that Santa Clause is responsible for creating the virus,
Santa could have received the virus and does not even know he is transmitting it. So if Santa is spreading the virus without intent, I don't think he should be punished do you?

so therefore when tracking down persons responsible for sending spyware and viruses prosecutors must be certain that the person is the one who created the bug and had malicious intentions,... and that takes more than just the ISP's to determine that

ISPs and law enforcement do try to track down the originators of malware. The problem is that they can be hard to trace. Many use a botnet (other people's infected computers) to spread malware and hide behind proxy servers.

Do what I do, I reverse engineer a virus when I get the chance and track it back to the writer. They are so arrogant most of the time they leave their calling card embedded in the code, usually an anonymous email address.
