He was involved in a motorcyle accident and is waiting on a judgement in his behalf. My question is if anyone knows if this money will be awarded to me by the court or if I'll have to sue him for my children's money.

Many States have a child support recovery agency that doesn't charge for getting you what you are owed.... contact them and explain the situation.... they can attach any money that he may be getting and even more.... This would be the cheapest and easiest way to get what you are owed.

Contrary to what Arthur W says this is not true.... it may be in Florida but not in many States... money from workers compensation or personal injury are not automatically attached.

In most states, back child support is paid before any judgements or garnishments. You may want to make your attorney aware of the situation, if you haven't already done so. They can make this happen sooner, instead of the money being held up in the court system for a few months. Good luck!

Any settlement he gets will be garnished or confiscated to pay his arrearages to bring his account up to date. Now our legal system is far from perfect so there is always a chance this could slip thru so be ready to notify child support collection agency or quicker sue him in court. You may want to contact the collection agency of the pending settlement and save alot of time. Child support takes precedence over everything else

As a ex hubby my self,, You need to stay on top of this, if it is in the courts, they will see that he owes you the money and take , its like the if he gets a ck from the IRS, they will see he owes chils support and pay you first before he gets anything, and whats left he will get,, Im sorry to say this but for 14 years I NEVER MISSED one payment but i read alot of stories about peaple who have ,, good luck !!!!!!!!!!!!

If your ex has $$ coming to him, you better believe he will have to pay up his child support payments!
BUT~~~it's up to you to keep going to court or where ever you have to go in your State for child support payments, until they garnish his wages.
They throw deadbeat dads in jail these days.
I was recently on a cruise and they took a guy off the ship in handcuffs for not paying child support! (he can afford a cruise, but can't feed his children!!)

I would get your lawyer to file a judgement against that settlement if I were you. Do it before he gets the money and hides it on you.

you will have to sue. The money is going to come to him and his lawyer first. Bills will have to be paid. Best bet is to get lawyered up and go after him, start now so when the money comes your all prepared and ready to attack his pockets

settlements arent taxed are they? if not then i dont see that it would be easy to get that money
