My ex husband who came to pick up our children yesterday tells me he's going to jail for a month and then being put on house arrest for a flubbed up job(carpentry work) and is being sued for 15,000. Does this make sense to you? I mean the jail sentence and all? He's been known to lie to me in the past so I guess I'm skeptical and being he has visitation with our children I would like to know the real reason he is in jail. Is there any way I can find this out?

My ex has always been behind in child support and I am going through child support enforcement for this issue. He told me about going to jail in order to ask me if the rest of his family could have visitation while he was in there. My question is about him lying about the charges. If he did and is a possible threat to the wellfare of my children when he gets out, as a mom, I want to know about it. In other words, since his reason for going to jail sounds so bogus to me, I'm wondering if he's holding back the real reason because it is drug and alcohol related or something else I don't want the children around when he gets out.

This sounds like a "tall tale" and I think he is trying to set you up for him going into arrears on child support payments.

In the United States, we do not have debtors prisons. A bad carpentry job is a matter for the civil courts. Although he may be sued for $15,000, that is a different matter. His obligation to provide child support is paramount.

You can find out whether he has any criminal charges, either from the point of view of history or pending charges by contacting the clerk of the criminal courts in your county. Not every county has criminal records available on the internet, so you may have to call the clerk's office or actually go there and have a clerical person look up the information for you. You will find the people who work at the clerk's office to be quite accommodating and very nice.

You can find out whether your ex has been sued by checking the judgment docket in the office of the prothonotary or clerk of the civil courts. In fact, you can even go in to the clerk's office and read all of the pleadings if you want to. In some states, this information is available on the internet. It is not available in my county in Pennsylvania at the present time.

If there has really been a decline in your ex's income, he may be petitioning the court for a reduction in his child support payments. I personally don't think he is going that route -- I think he is trying to set you up for his decision to go delinquent on child support.

There is not enough in the facts as you presented them to justify the revocation of his visitation privileges.

My best advice is to hire a family law attorney to look into these matters. I think this will ultimately end up in litigation, and my best advice is to be prepared.

The only scenario I can come up with that would send him to jail under these circumstances would be if he committed fraud on a contracting job, and I think the sentence would be a lot more severe for that. But there should be a list of convictions somewhere in your city hall or possibly on line.

Sounds to me like he is trying to get out of paying child support!

He might be going to jail for the carpentry , a friend of mine got arrested for a carpentry job because his ex stated he deliberately tried to kill her . How this is possible , I have no clue . Anyway the charges were eventually dropped .

My suggestion to you is to go back to your lawyer , tell him the new situation and have his visiting privileges revoked .

Nobody goes to jail for a messed up carpentry job. He has probably committed a serious crime and doesn't want you to know so he won't lose visitation rights. Call the courthouse - you have a right to know.

their is no debtors prison, the only thing i know in regard to a civil matter that a person can go to jail for is back child support payments

I think you ex is once again laying to you, sounds like you should not be surprised at this

Go to your counties website. They should have a section where you can look up anyone who served time in the county jail.

He has a drug problem.

I know it sounds crazy and cynical for me to say this, but I have seen this happen SO many times. This man needs help.
