A local band uses songs other than their own. They do not belong to bmi/ascap, so no royalties are paid. Does anyone know what happens if this band is found out? They even put other performers songs on their C.D.

OK as for performing cover tunes, its not the bands responsibility to pay ascap, etc... its the clubs who pay flat fees to have music played there. BUT........ they ARE supposed to get permission from the original artists if they put the songs on a cd.

Kaisergirl is right, we were playing for a restaurant club, the owner was paying us! one day he said that bmi wanted a yearly fee from him for us playing music in there! He didn't want to pay the fee, so he had to let us go!
