No. However, if you missed your court date then they will have a default judgment. After the judgment they can file a Writ for the garnishment and take up 25% of your wages (depending on the state)
If your court date has not passed be sure to show up, you should be able to sign a stipulation and work out a payment plan. FYI in some areas if you sign a stipulation and default the company can go straight to wage garnishment without any notification. So only make an agreement you can keep.

They have to go to court. If it is a SUMMONS than it is summonings you to go to court, they havnt started taking anything out yet. If it is an ORDER, then they did already go to court. They might have tried to contact you and you didnt show up to court so they got a judgement against you. If it is a summons, go to court on the day, work out some sort of deal with them and a payment plan.

No, they must go to court and get the court to order the garnishment first.

Garnishment sounds like they already went to court .
Were you a 'no - show' ?
If you flaked , then they won by default and can take whatever you have to settle the judgment .

no -- the court date is to determine if they can even garnish your wages. you might want to consider an attorney who is good at this kind of stuff.
