I goofed and now have a second moving violation within 1 year of my last one. I took traffic school for the first one to remove the points. According to the DMV site, I can't take it again within 18 months of the first violation. However, the courtesy notice I just got from the SCC court house offers me a chance to take it again (at a $14 premium over not taking it).

Should I just go ahead and take it?
Are they going to realize later that I already took it and say that I can't (and not refund the money)?
Are they going to wait until I take and pay for the traffic school and then say that I can't do it and leave the point on my record?
Is this common?

For the level-2 school, how much does it usually cost and what are the chances of being allowed to take it (is it common, uncommon, etc?)

They send that to everyone. My wife took traffic school and she just wasted the time and the money and worse yet.....by getting a mark on Cal DMV of a ticket conviction and traffic school for the same incident, it tells your insurance company that this is your second mover in 18 months. They are not fools.
I meant she took it twice within 18 months

Songbyrd is right. Most courts require you to verify that you have not been to traffic school within the past 18 months. It appears that the court you are in does not do so, but that does not do you much good.

As you know, when you go to traffic school you still have to pay the fine, and a traffic school fee, and the cost of the school, so you don't save any money.

The DMV gets a report of citations which are dismissed due to traffic school, and only one in any 18-month period is confidential. (Vehicle Code section 1808.7.) So your insurance company will know that you have two citations. (Of course, since almost everybody in CA goes to traffic school for a first citation, the company will be pretty confident that any conviction is upon a second citation.)

The only thing that traffic school will do is keep it from being a point on your DMV record, but unless you are planning to get several more tickets in the future, or are a commercial driver, that is not going to do you much good.

You can try but are probably going to waste your money. Santa Clara County is probably unaware of your previous violation or sent the standard form they send to everyone.

If you go to traffic school the state will see it and probably disallow it because the 18 months has not passed.

You probably should just pay the fine and take the point and reform how you drive so it doesn't happen again.

California now allows offenders to attend a secondary traffic school. This is a twelve hour class instead of the initial eight hour class. You will renew your 18 month wait period after attending this class.
