This happened to my place of business a while ago. Someone broke the window to my office with a rock and i was worried they would come back and try to get through the broken window to cause further damage or steal something so i waited there late into the night. They never came back, but my question is what are my rights as a citizen if someone is vandalizing my personal property? Can physically restrain them while i call the police?

Unless someone is committing a felony offense (breaking a window is not) you cannot detain them as a private citizen.

Not to mention the dangers associated with that, even officers who have hours of training and years of experience still end up with injuries when someone wants to scuffle.

The best thing is to setup video cameras and catch the dopes in action, and/or get a security system. A security system will stave off about 95% of the criminals out there.

The best thing to do is set up video cameras to record actions like this so you have them for court. You may end up getting hurt or killed if you try to aprehend them, after all, you don't know if they might have a gun or knife.

Since this is a misdemeanor, I doubt you would have a right to detain them so to protect yourself, check the laws for your area to see what your rights are, whether it's a vandalism or a theft (some thefts are misdemeanors, some are felonies, depending on the value(s) of the stolen property).

Yes you can restrain them in most states, (holding) Police could inform you better. An 82 year old neighbor living down the block walked in his bedroom, was hit in the face and knocked to the ground. He got up grabbed a pistol he had and ran to the window, stuck his arm out and shot the guy in the head. Called the cops who said he could go to jail because the guy wasn't in his house and wasn't a threat to him anymore. Then the two of them walked out side and threw the body back in the window. Told the corner what happened, he wrote his report and that was the end of it.

That will vary by jurisdiction, but I strongly suggest you just call the police in that situation.

Even if you state has a law for citizens arrest, it may not apply to juveniles.

Not to mention the possibility of getting hurt is quite high. If this person knows you are going to turn them in, they will most likely fight. They may even be armed, or high on drugs, or both. Your property is not worth your safety.
