If there is a visitation order and he chooses to push the issue, then yes. If you do not send her over you could be held in contempt of court. The best thing for you to do is go back to court to have the visitation agreement modified. Your daughter would have to tell the judge that she didn't want to visit her dad. You could try talking to your ex first, your daughter should tell him that she doesn't want to visit so he doesn't think that this is your decision. Explain to him that he can force her if he wants to but that you will take him to court if he does and that the judge won't make your daughter go at her age. Either way, his daughter won't be visiting because she chooses not to...it can either involve court or not. My step- daughter made the same decision about her mom when she was 13. Luckily her mom didn't force her, and still doesn't..more than likely your ex won't either

What does the divorce decree say. If it says he has visitation rights, then you would be violating a court order. Depends on the decree.
