The Fair Game policy ITSELF was not abandoned. Simply LABELING people as "fair game" was denounced. The policy is still fully in force... people simply aren't "declared" to be fair game anymore.

They have certainly sued any number of those who oppose them. I would not be surprised if they tricked or lied to people such as this as well - that seems to be a universal trait for many if not most organizations. I don't know of any documented cases where an enemy was destroyed.
