Her docter checked her out and nothing serious. The other two and myself have no visible injuries. But we were all shaken up.

The insurance of the driver called me and said it would pay for the repairs and car rental. But no discussion about medical or mental anguish or anxieties that we experienced after the accident.

In this kind of accident, does the insurance (AAA or triple A's) pay a specific compensation for each person regardless of whether there are serious injuries or not?

Nope - you have to be injured to get paid for a bodily injury claim.

No payment for inconvenience, mental anxiety. If you don't want to suffer the mental anxiety or inconvenience of being involved in a car wreck - don't drive or ride in cars.

Let the adjuster know about the child that went to the dr. They will probably offer a small settlement to cover the bills.

Sorry - no free money for you.

You do realize that money grubbing attitudes like yours (I should get paid for injuries I did not have) is why everyone's car insurance rates are so high.

They will not pay for people that are not injured. But in your case, I can see them covering the childs doctor visit so long as you can show bills that document the cost. If you had a police report done that should also note any injuries sustained..(if you pointed it out to the officer). If not, you still have a good chance of getting the medical bill paid so long as it can be associated with the accident.

Here's a tip, don't lie. If all you really want is the bills covered just be honest. Adjusters will appreciated the honesty. Plus if you start making crazy claims they will be far more skeptical about your entire claim, even the legit part of it.

you state that you had 3 kids in your car and that "her" doctor checked her out, which i guess means that this child is not yours;

if that is the case, then the parent of that child will be offered a minor injury settlement for her contusion (bruise) on her head;
they will reimburse the parent the doctor visit (guess around $100) and couple of dollars for pain/suffering;

since you nor the other 2 kids were not injured, they owe for your repairs and rental; nothing else;

if on the other hand the child with the contusion is yours, you need to notify AAA you took this child to the doctor to be checked out for her contusion;

usually when you report a claim, one of the first questions asked was anyone injured? if any of the children are not yours, then we usually ask for the parents name and phone so that we can contact and verify the kids are ok;

and also; if you "suddenly" start seeking treatment, they maybe suspicious; like i said, i sure you remember someone saying are your injured, did you seek treatment and most likely this was recorded at the time.

see this is the type of situation when you have to get an attorney, they will let you know if you can get enough money for them to take the case, but with back injuries (hint hint) you usually dont feel any pain at first, the pain normally surfaces later, and x-rays normally cant pick this up. call a lawyer before you agree to a settlement with the insurance company
