Probably either could be correct. I strongly prefer the "of." You would not say "a penalty $1,000," you'd say "a penalty of $1,000." I prefer to keep it parallel, because what you are really saying is "a penalty of $1 up to $1,000." Most statutes are written my way.

Either is gramatically correct.

"of up to" is more common, and a more modern usage.
