My husband and I were recently made redundant a week before we apllied for our spousal visa to allow me to live with him here in the UK, we are worried that because of this we will not be granted the visa.As we both ran a gastro pub, and lived above the premises we are now busy looking for accomodation too! So we are both very stressed! I have also worked more than the 1 year allowed on my 2 year visa, so how will this affesct my application process?

How strict? VERY strict. You will have to demonstrate that you can support and acommodate yourselves without public funds - difficult without home or job, unless you have huge savings.

I take it you are on a WHM visa. You need to be careful here, the purpose of the visa is strictly tourism, with limited work. Once you are talking about settlement, your WHM visa could be curtailed (cancelled) as it would appear that your primary purpose being here was no longer tourism. If your spouse visa application is refused, you will probably b expected to leave the country. Did you get married with a Certificate of Approval from the Home Office or in the Church of England? If not, I can't see how a spouse visa application would succeed, but you should take specialist legal advice.

Overworking would probably not be fatal to your application, and indeed it's quite likely that the Home Office will not become aware of it unless you detail it in your evidence.

If your application is refused, you can appeal; but check if you have realistic grounds for appeal first.

If the worst comes to the worst, go back to Oz or whereever, wait for your beloved to sort out employment and home, and apply to return on a spouse visa.

You don't say whether you both from Europe or just you. This is the sort of situation which is annoying Britons. You say you have worked longer than the 1 year allowed on your visa, you are now committing a crime and therefore under our laws, subject to punishment. Ours is only a small Country with lots of people claiming it and tensions are running high, why on earth do people still want to come here? We want to be a tolerant nation but we are being tested to the limit. Good luck, but apart from the people who know you I don't think you will get much sympathy.

Unable to answer in confidence because you do not state where you are originating from eg visa national or EEC

I will assume a visa national as you mention 2 year visa but i am wondering if you were permitted entry as a student?.(work restriction)

You have not done yourself any favours by breaching your immigration status and working longer than allowed

I suppose it will come down to another restriction such as no recourse to public funds for a period

Should you have overstayed the stated time allowed on your Visa you could be arrested and deported,quite rightly so.You are dishonest and have little or no chance of ever getting a British Visa again.Goodbye....
