My brother went thru the same thing. He had hypertension before his new insurance kicked in. After he got his new insurance which he privately pays for, he had a really bad seizure (1st time ever) and the new insurance tried to say it was a pre existing condition related to his hypertension. He had another seizure and it was really bad, so he ended up in the hospital. Once again, they are saying its a pre existing condition.
This is flat out ridiculous. The insurance has refused to pay any of his bills. They have given him the run around. Now since he drove a bus, he has no job because of his seizure disorder which is new.
He has turned the insurance into the better business bureau, State representative, a lawyer and still cannot collect the insurance money. He is so poor his wife is now working at Walmart full time. They cannot pay their hospital and clinic bills related to the new seizures and they are refusing to treat him.
It has ruined his credit rating. He is in dire straits.
If I were you, I would check out your insurance company to make sure they are not practicing fraud. It can get nasty.

Ask the billing department at your doctors office to call the insurance company to verify that the correct code was used. They may have billed the insurance company with the wrong medical code or even gotten you mixed up with another patient. Most of the time, the billing dept is willing to help you with a matter as they want to get paid.

Then I would contact your insurance company and let them know it wasn't a pre-existing condition. The letter you got, should have told you the number of days that you have to appeal the decision and what you need to do to appeal.

You need to contact your insurance company as well as have your dr. write something up that you had not been to see him for that condition before. You can appeal the payment...i've done it before and won. Don't give up.

good luck.
