Yeah. That's unacceptable. What you need to do is for about a week, document EVERYTHING that they do with times (was in the break room from 4:00 until 4:33) and with actions. Take that so that you have a better argument.

If your boss is unwilling to do something about a problem, yes, absolutely call HR. What kind of authority do you have? If you have the power to write up employees behaving inappropriately, then do so. This is unacceptable behavior on the job and you as a shift manager should share some of the responsibility in the disipline of these two employees. You should not just wait around for your boss to do something. However if it is out of control, then involve your boss, if he is unwilling to handle contact HR.

Have a little meeting with both of them. Clearly outline their working hours and break times.
No one should be outside smoking for 20 minutes, or eating ice cream unless it is their break. The touching and petting issue should also be discussed. This is not acceptable behaviour while working (specifically not on the work premises).
Let your boss know about this.

maximum states have "worker at will" regulations meaning employers can hire and hearth all people. regulations guard workers from sexual harassment and being fired for having a disabte ily or sexual preferrence, race etc... yet all an organisation has to do is create a valid reason. regulations may be paid for via the working classification (paying the salaries of regulation makers) yet seldom could have adequate money to have the same regulations enforced. shop your self multiple frustration and merely get yet another activity the place you would be favored. it is not truthful, yet that's existence. you are able to waste your existence scuffling with something that's no longer well worth it, or pass on and hit upon a happier placing. What you describe sounds like a crappy place to artwork.

If you are the shift manager you need to be able to handle the employees you manage. Going to your supervisor asking for them to resolve this creates a loss in your credibility. You need to call them both aside and tell them there behavior is unacceptable and unprofessional and they need to keep there personal life out of the work place. Let them know that this is there first warning. If they can't keep there personal business out side the work place they might want to start looking for another job.

Without knowing what type of business you are in...I would first meet with my superior and request that I be allowed to give this amorous couple their LAST chance. I would call them into my bosses office and reprimand them professionally in front of each other and my boss. Make sure you have them verbally say the understand then send them back to work with a all business smile. When they leave, thank your boss for his guidance and support and get back to work.

After a couple of verbal warnings, I would think that you could "write them up", when you put a complaint or warning in writing, it automatically goes in they employee file. Therefore, it would have to go to HR and you wouldn't be going over your bosses head to tattle (which would P him off big time).
Just make sure you're very careful with this letter and that it's very professional so it doesn't make you look as stupid as them.

You are a MANAGER... time to manage them.
Take each one into your office and talk to them about their behavior.
Inform them of their allowed breaks, and if they take anymore breaks than what they are allowed they will be written up.
Mention their behavior should be appropriate for the workplace.
Put everything you talk to them about in their records. Inform HR as well.
Inform YOUR boss what you are doing.

Their behavior is unprofessional and it is obviously affecting your satisfaction with your job.
Tell someone, anyone, who can cover your shift or at least observe their behavior and let them handle it. As a shift supervisor, you don't get paid enough to deal with bozos like this.
