My husband went in the hospital last night.According to him he gave his truck keys to a friend.He didnt say anything about anyone driving it.They were out together and his friend supposedly didnt want him to drive.They had called several times from a cell phone number that he said was his friends.After I found out that he was ok but being admitted to the hospital I decided to call and ask his friend where the truck was so I could pick it up.I was told to hold on (by his gf?)then asked who I was and started acting psychotic stating she wasn't telling me anything would not put him on the phone.I heard her whispering to someone.The title is in my husbands name.I have made the last 4 payments.He isnt in a position to file a report.I contacted the police and they keep trying to bounce it back and forth between 2 jurisdictions and neither want to deal with the paperwork.Its financed and he still owes a bit of money on it.So his friend is withholding it?Consider it theft?What to do?

Not a drinking related matter.He has emphysema and had an anxiety attack.His friend insisted he not drive and to get someone to take him to the hospital.He didnt tell him he could drive the truck.He obviously thought he was a better friend than he was.I notified are insurance that my hubby was in the hospital and his friend took the keys and would not return the vehicle.At first they refused to open a claim.The friend called the police back after they went to his home and said he hadn't seen him in 3 wks.The officer still says he doesnt want to file the paperwork but thinks the guy is lying.Insists on not wanting to file a report because of unneccessary paperwork when it could randomly be returned.I believe its more necessary since he now claims he doesnt know where it is.

Stay after the police to take the theft report. You may have to go to the police department. They may be more willing to help you if you show up in person and file the report - rather than you calling and expecting them to come to you.

If the friend had permission to take the car initially - that does not mean he has permission to keep it forever. Once he's outside the scope of the permission the vehicle can be considered stolen or used with out permission.

If the friend were to have a wreck with the vehicle and people got hurt - you/your husband could be liable for the injuries -unless you could prove it was stolen. You will need a police report to do that.

If a person does not return a borrowed vehicle it is a crime. It is not considered a theft but the report made in most jurisdictions is for something like deceptive practice or embezzlement. it is the same report that is made when a rental car is not returned on time. Once the report is made the information on the vehicle is placed in the computer system just like a stolen car. If an officer runs the plates or the vin it will come back as illegally taken. You are the wife so you can make the report. Your husband has to say to you that he only gave the other limited permission to take the car. Be sure to bring a copy of the registration or tittle to confirm plates and vin.
Don't go into the whole involved story. The car was supposed to be returned to you at your home so that is the location of the crime. The other guy was given the car for a time but now refuses to return it, end of story, unless asked for more.

In NC we call it unauthorized use. Failure to return a vehicle by a known party after being given permission to use it is not a theft. Sort of makes me wonder why your husbands "friends" would be taking him to the hospital. And why wouldn't you just go to the Magistrate's office and file a report yourself?? You always have the option of going to the Sheriff's office and taking out a warrant. If they get stopped, they would then contact you to come and get the vehicle. If two agencies are wasting your time arguing over who's going to take care of the report, get the Sheriff or the state police involved.

Embezzlement.

If they came over to your house, broke into the truck and stole it, thats theft.

He gave it to them as he was going into the hospital (you didn't elaborate on that part) and now you (who has equal right to it being married) say return it. And they don't.

Call the police in your area and tell them you need to report an embezzled vehicle. NOW. If they do something in your vehicle, you may be responsible.

If the police want to play games, ask for a supervisor (seargent) . This is a no-brainer. Call them now. 9-1-1.

I would file it as theft. Then with a police report the cops have to deal with the paperwork. That is what you pay taxes for, make them do their job! Good luck!

bet there was some drinking involved.......
he gave him the keys, so the guy didn't steal it......
think when hubby gets out of the hospital he should get his car back and then find some new friends.
