Call a travel agent to ask. They will know.
As far as I know, the regulation is mandatory starting January 1, 2008 (this coming January). Since you'll be coming back after the restriction is put in place, you'll be expected to comply.
If you all go ahead and apply now, you should have your passports in time. You may want to expedite them, just in case.

If you are traveling by air, you need a passport as of September 30, 2007. If you are traveling by land you will need a passport as of January 1, 2008.

Passports are not yet needed to DRIVE to and from Mexico. The date has been pushed back to June, 2009. You will need your certified birth certificate and a picture I.D. See Website below.

You need passports if you're flying (yes, even juveniles).
Either way, its a good idea to have a passport.

whether you NEED one or not, it's a VERY good Idea to HAVE one.
If you're driving, I dont' believe you NEED one. But it sure makes life simple at times to have it.
