As a retired Police Officer I can promise you that you WILL get a ticket unless your seat-belt is worn properly. Tucking it under your arm defeats the whole purpose of wearing one in the first place. I suggest you get one of those lambs wool padded shoulder harness covers from your local car parts store and once installed, it won't rub your neck anymore. It will save you from having to pay an even bigger fine and a trip to traffic court...

I'm guessing you're "vertically challenged", right?
Most cars nowadays have adjustable seat belt height that will usually fix this for you, but if not, here's what to do: check the link below. It's for a seat belt adjuster with which you can alter the angle of the shoulder strap so it doesn't rub your neck, but still gives you proper protection in the event of an accident.
Don't drive with the belt under your arm, that's dangerous and doesn't meet your legal obligation, I wouldn't think.

Seatbelts are designed to be used in a specific manner to be effective. The physical forces exerted against your body during a collision can be many times your body weight, not wearing the shoulder belt as designed could render them ineffective and could do you more harm than good.

Yes, it's illegal in all states that have a seatbelt law. You must wear your safety belt "properly" which means over the shoulder. Otherwise you are violating the seatbelt law and subject to fine.
You might look into one of those velcro covers to keep the belt from rubbing your neck.

u will regret not having the belt on the right way if something happens and u get into a wreck. even a wreck at 35 mph will generate a hell of alot of force at impact. think u'll need to find this out for urself tho. i doubt u'll listen anyway...it's basically like no belt on at all.

More likely than not, you will be ticketed if caught. The police have heard all the reasons people don't wear them or have them improperly secured. Should you be in an accident, you will also get ticketed even if it isn't your fault.

AS an EMT, I will tell you that wearing your seatbelt that way will cause much more injuries to yourself and you will still hit the windshield.
Seat belts are designed to apply the force across your body on the strongest points. Doing it the way you are, you are putting yourself at risk of serious injury.
