I have an 11-year-old daughter. She is from a previous marriage. Her father has a long list of arrests for dui's and everyone knows he does drugs also. He has been out of her life since she was almost 6 months old. He came to a friend of my and my present husbands New Years Eve this year. Still don't know how he knew where we were. My daughter was with us. He tried to start a fight (he was drunk) and I made him leave. Anyway, on the divorce papers state I have sole custody and care of her due to visitation to him. He was supposed to pay $44.00 a week child support. He hasn't paid any. I want to know if he has any rights and if so what are they. He has been out of her life for so long, no contact, and no child support. He hasn't paid it for just over 10 years. I live in Alabama. Does anyone know what I can do? Does he have any rights anymore?

by the way, i am not attacking him. he came drunk to someone's house and started cursing and screaming and had my daughter scared to death.
he and his family have aways been told that they can see her anytime they want.

I'm not sure what the laws in Alabama are, but in Connecticut you can sue the parent for all back child support and if they don't pay it the court will take it out of their pay--even out of a social security check! Maybe you should take him to court--think of all the money--there would be enough to pay for her college education. I just did the math--I'm no genius at it--but this guy owes you $180, 060! I don't think he should have any rights unless he can stop drinking, start working an Alcoholic's Anonymous program and pays you every cent he owes you! I wish you good luck with this. Mystle

You need to check the laws in your state. Go to www.myparentingportal.com, there is a link to custody by state. Whether or not he pays child support has no bearing on his rights as a father, it just means he is a deadbeat dad. You can probably petition the court for him to have no visitation and have all his rights taken away because of his drug and alcohol abuse. There were plenty of witnesses to the incident and they could testify in court. I am sure that if you threatened him with that, he would disappear again.

if the guy isn't paying support and never sees the child, he probably has no chance at getting visitation.. he's abandoned the child...

i suppose he made a scene and found you when he was drunk, because old feelings of guilt and maybe anger arose in him that night.

people do stupid things when they drink, that's for sure.

ok well dont label ppl by drugs or ****...i have been arrested twice and i used to do alot of drugs and i still smoke cigarettes and im not a bad guy...from what i read i dont think he has rights...
