No time for the paperwork
Our civil war started out as a picnic.....People actually packed up the family and went to the field to watch it like it was a ball game. Entertainment was lacking back then!

In the American Civil War it started out as a police action, like sending the national guard on the part of the Federal government, then the south declared independence, and the police action went to the next level and so on. At first Washington had no one to "declare war" on.

What is a "side?"
Declarations of war are between nation-states. It won't do to try to force the formality of that sort of war onto conflicts that are of a different type. For instance, the US led a brilliant third-generation war against Iraq, and finished it in short time. It took a considerable time for the Bush administration even to realize there was a fourth-generation war in its aftermath, and it's certainly hard to win a war if you don't know it's occurring.

There are no rules in a civil war. civil war is the most deadly of any wars in history. What we, or others, do in civil war is among the worst atrocities.

No declaration of war. Mainly because it's usually the sitting government versus the rebels.
