Sorry about this but......everyone I know is here in R&S so that's why I ask this here. I hope it doesn't get deleted.

My wife and I live on the 2nd floor of an apartment complex. Our downstairs neighbors smoke like chimneys. So naturally, we end up with the smoke smell in our place from time to time.

We don't really know them too well....it's more of a "hi" and "goodbye" relationship. The smoke bothers us but what can we do? They pay rent and have every right to smoke in their apartment so..........

Any suggestions as to how I can approach this without possibly getting into an arguement?

YES,
I have some friends who smoke and their kid has asthma! They bought a honey well air cleaner and you can't smell smoke at all in their house! And I have a nose like a hound dog!
It's worth the $100! believe me.

I live in a very large 160 apt complex. I live on the second floor. I am blessed that the neighbor on my right does not smoke and the neighbor upstairs and downstairs. The neighbor across the hall does not smoke. My neighbor to the left of me does smoke. I in a joking way said to him once "You must have been stressed last night and smoked a lot because I could smell your smoke at my apt. He said he had a friend over and she was smoking cigarettes as well. I now have an air purifier& it helps. Smokers really don't know how their smoke can travel.If only they too would get an air purifier........

Hmmm that is a good question!
We have next door neighbors who also smoke continuously. But we can close our windows to keep the smoke out....
Does your chimney have a door that shuts? Most chimneys do- but I guess the smoke is still filtering through?
I think you should let the landlord know-- the apartment manager. I mean are you living in a smoking apartment or non smoking?
I would definately tell the manager of this problem, they should be the ones to fix it.
Yeah like otheres mentioned, purifiers work good but they are expensive.

I'm a smoker, I have been for over 30 years. Even I can't stand the smell of cigarette smoke, so I understand where you are coming from.

For the past 22 years I've stood outside in every type of weather to indulge my habit, and to help protect the health of my children. The effects of second-hand smoke can be just as devastating as the effects of cigarette smoking.

They pay their rent--you pay yours. You also have the right to live in a healthy, smoke-free environment.

Speak with them about this issue, doing so in a polite manner. It would help your cause if you could provide proof that either you or your wife have a respiratory condition such as asthma (I don't know that you do).

If this doesn't work, speak with your landlord. This could be a touchy subject, so be diplomatic. Good luck.

hmm forget the air purifier why should you have to go out on a limb to keep yourself from dieing early and spending money for someone elses habit. How does it come up into your place? Sounds to me like there is a "leak" in the system that is making the smoke rise up into your place. I would talk to the landlord first to have that fixed and if that fixes it but there is still a smell than I would do a little one on one confrontation. But than again, how can you tell someone to smoke outside or something like that. Fix the space where it is coming from, or maybe they can smoke somewhere else in the house? It is gonna be hard to tell a smoker not to smoke in there house bud.

I had the exact same problem!!! Eventually everything I owed, including my furnisher reeked of stale smoke.
You can try talking to your landlord, but if smoking is allowed they can't do much. Ask your neighbor politely if they would mind not smoking in the apt b/c it bothers you. If that doesn't work I suggest moving b/c it's not worth your health risk to stay there. Sorry and Good luck!!!

Read your lease. Somewhere in there it should say you have a right to "quiet enjoyment." That simply means you have a right to live in your apartment undisturbed. The management has agreed to provide you with this quite enjoyment.

I would first approach your downstairs neighbors and tell them their smoke is bothering you. Ask them if they know of a solution to the problem. If they're not helpful, then tell them you'll go to the management/owner to see if they have a solution.

this really depends on How bad the smoke really is
and if either of you are allergic to it. if one has smoke
allergies this other couple/person should understand that.
one has to have fresh air, is their schedule different
so you can open your windows when their gone? do you both
have balconies, if so maybe they could smoke outdoors?
i hope you can resolve this without problems. it's a very
touchy subject!!
