Are there signs in the parking lot that say something about "this store is not liable for damage due to shopping carts" or something like that? If so, you'll either have to pay out of pocket or file an insurance claim. It's a hazard of working in retail. Park farther away from the store or deal with damage from shopping carts.

If you have insurance this would be filed under the comprehensive coverage. No one is at fault, it's one of the risks of parking in a lot where there are carts. Same as if you were parked at a baseball field and a foul ball hit your car. Accidents do happen. :)

Person responsible for securing the carts.

However usually these stores have a sign up absolving the operation from any damage caused by carts.

parking lots are 50/50 meaning you are responsible for your own damage while in the parking lot, if another car was to hit your car, Your insurance covers your car and his covers his. Same with the shopping cart.

My truck got hit in a parking lot, we even called the cops to figure it out, and at the end of the day, once you enter that parking lot you do so at your own risk....

This is in Canada, I know the state's are sue happy so maybe you can sue them for the damages?

The person who last used the cart.

If your company has signs up stating they can't be held responsible for damage to parked cars then the only person responsible is the last one that used it.

The clerk can't be held responsible unless it states in his contract that he needs to be at the secured place at all times.

I know it sucks, as the person has gotten away with the cost.
