I have been denied last year in October,because i didnt have strong evidence that im gonna return to my home country,(but i WILL return and i DONT WANT TO STAY IN US).I was supposed to go and visit my sister who lives there.I didnt have money for university,and i did have a couple of jobs which i had to quit because of bad treating.My sittuation didnt change since.I am still looking for a good job where they will treat me as a human being.My mom and i want to go to visit my sister on Christmas and New Year.I dont think she will be denied for a visa because she have a steady job for a long time.But i dont know what to do.What are my chances?And should i apply or not?I dont want to get denied.What should i do?

If you do not want to be denied, do not bother to re-apply at this time - you will not get a visa. Not only have your circumstances not changed, I notice you are also asking about overstaying a tourist visa, and about Au Pair work - it does not look good for you.

No. Korea is not on the Visa Waiver Program list, which is the only way you can come into the States without a visa. Her having a Canadian tourist visa ONLY permits her to visit Canada. The only way she can enter the US is to get a US visa, which is never easy. There are a lot of visas but most require 4-year college degrees or 'specialised' careers (scientists, for example), or require her to be hired by an employer in the USA who has proven he can find no American workers for the job. Another way is through a cultural program such as the au pair programs (which require experience in childcare and commit you for one year) or on a Student Visa, which typically last for a year and require proof of a substantial amount of money. Look up the USCIS for a list of visas.

I wouldn't bother applying again unless you can prove that you have valid reasons for returning to your country - a steady job, own your own business, strong family ties (husband and children), etc. Otherwise, you will probably be just wasting the application fee, especially since you have been denied in the past.

It may not seem fair, but the consular officers who have to make decisions about your visa do not look at you as an individual - it is too much trouble to try and assess your character and no real way to do it accurately. So, they go by statistics, and statistically speaking, you are a bad risk for returning if you have nothing to lose.

if you have already been denied entry into the US? the likelyhood of you receiving one? is not good,
you are in a position that makes you a likely candidat NOT to return to your home country.

You need to show that you have sufficent funds to maintain your stay for that period (six months usually) and you have a return address.

I don't know which country you are from, but you can usually go for three months without a visa anyway.

you need to proove what they are asking.try again but it is difficult
