Only if you were in the crosswalk. People can illegally cross the street Jaywalking and get hit. Did someone get the licence number of the car and who was issued a citiation? The pedestrain or the car? Liability insurance from the car owner will pay up to the mounts of the policy. Or sue the car owner, Attorneys should be lining up to take your case.

if you have car insurance with either PIP or medical coverage, it will cover your medical bills; your insurance company at that time would then go after the other owner of the car that struck you;

now the other insurance company would have to determine if this driver was at fault for hitting you; if they determine you are at fault, they would owe nothing;

now i know other people are saying you should not have to file for your medical bills under your own policy, but in most cases, the other company if they accept liability are not going to pay your bills; they will reimburse you with a injury settlement when you are done treating; in the mean time you will be getting bills from the providers and could go in collection while waiting for the other company to make a decision; even if you tell the providers to bill them, the other insurance company is 3rd party and not liable for any bills; when you have treatment, you sign a contract that you will pay them, so the reason for your own insurance company to handle;

If you have an accident report stating that the other person was at fault, their insurance company should pay for your medical bills. You need to keep good records and deal with the people in a courteous but firm manner.

If the driver did not have insurance (illegal), you can file a claim against them personally in small claims court.

Yes. But you should go through the driver's insurance company and make sure you always keep a copy of the paperwork and keep track of the communications. In case the total amount of the bill exceeds the max. coverage of the insurance, you'll have to deal with the driver through a lawyer.

do you live in a "no fault" state? -mandated personal injury protection-
are you an insured driver anyhow, or do you live at home where your parents are insured drivers?
if you answered yes to both of these things then no.
your pip is primary up to the limit of which purchased.
even as a pedestrian PIP is primary.

if you answered no to the first, or first and second question, then yes, their insurance company will pay you for your medical bills.
file a claim against then and have the bills faxed to the claims department.

More than likely, the driver's insurance company will pay for the medical bills and anything else that incurs as a result of him hitting you, if he is at fault.

Yes, if they have liability coverage. If they don't, you can claim it on your uninsured motorist coverage.
