I had DNA test done to my 11 year old son and his dad, I told him before he could see his son when he wanted and then he would never show up after promising my son that he would come by and this has went on for 11 years. and now he is wanting custody, and lieing about not being able to see his son, he has never help and told me he would take him and run to Canada with him and then told me he rather go to jail than to pay child support. He is at times abusive and how I got pregnant by rape from him. He has bought his son clothes but never let him bring them home for him to wear then never showed back up for him to wear them. Can I ask him to give up his fatherly rights so my soon to be husband can adopt him. I mean he hasn't been there and probably never will be. And my son is not wanting his dad in his life and he has told me so because of the promises that has been broken and he really does want my STBH to adopt him, would they listen to my son on what he wants?

He has even put him on a soft ball team then never took him because it got in the way of his bowling.

What was the DNA test for? Your child was conceived by unwanted sex rape, the man has never wanted much to do with your son, he can not provide a good, loving environment for him with a wife who doesn't want children, he has threatened to take your son out of the country and it seems to me he may get his time in jail for not paying child support. Offer him a deal. You won't take him to court for back child support if he gives up all rights to your son. Get married to your STBH and give your son a dad he deserves. If your sons father won't comply, play hard ball. Nail him for everything you can and DO NOT LET HIM SEE YOUR SON. You can get a restraining order out on him because you fear he my kidnap your son. If you can't get one then make him get a court order to see him. Then you can fight for your son. I've seen to many people give up on what could be a good thing because their scared of what the ex might do.

get to a lawyer and make him pay and also bring up what he told you about taking him away he'll never see him period and mabye sign his right sover.
