Always try to reach an agreement with the insurance company first. A lawyer should only be a last resort. Just be logical -- add up all tangible expenses and then try to arrive at a practical amount for pain and suffering and start from there. There are a lot of sorry-a** adjusters out there but there are also many, many intelligent, thoughtful and very professional adjusters that will truly attempt to be fair. If you don't like their offer don't yell or threaten to sue -- just tell them and see how it goes. The longer you can keep a civil and logical attitude the better the chances of a good settlement.
