She was having a seizure. The police came to the scene of the accident and took a report. She was taken to the hospital immediately after. THE PROBLEM IS, I HAVEN'T HEARD ANYTHING FROM THE WOMAN or her insurance. How can I make her pay for the damages to my car? I'm not a litigious person, I don't want to sue her. I just want her to fix my car. There is probably about $300 or $400 dollars worth of damages. What should I do?

For those not trying to help and would just like to be anal about it....If I had her insurance company's number I would call. The insurance company is not listed on this TN accident report.

Did you get a copy of the police report? Did you get her insurance company name and number? Did you get her license? This should be on the police report. If you don't have a copy, go down to the police department and get a copy. Call her insurance company and file a claim. Don't forget to take pictures.

The other claims people who have responded have given you good information. However, I will bring up something that may throw a monkey wrench into the whole.

Even if you locate her insurance company they may not cover your damages if the lady had a unforeseen stroke, heart attack or seizure. In many states (I've never handled TN claims) liability can be denied if the person has a stroke, heart attack or seizure. If she had had previous seizures etc then they won't likely be able to deny liability.

If a person who has no medical history of seizures etc has one while driving they are not in control of their car and it is considered that they are not negligent. If they have a previous history or diagnosis then they will be held liable because a follow-up seizure is forseable if it already happened once.

I have been on both sides of this issue on car accidents and in the states I have seen it used the denial sticks.

I strongly suggest that you contact this lady and politely ask for her car insurance info. Then report the claim to them and keep your fingers crossed.

I've seen TN police reports and they do not list insurance info.

The only way I've been able to get insurance information on TN accidents is to call the vehicle owner and ask her who her insurance is with.

If you call - ask her how she is doing first. She will be more likely to assist you if are pleasant and you ask about her health first (the message being that you are concerned about her as a person more than the car). Then you can tell her that your car had some minor damage and you would like to speak with her insurance agent about it. Ask her for her insurance agents name and phone number. Then contact the agent.

If she will not give you the information - talk to your insurance agent and see if she can help you.

Call ur insurance company right away... U should have at least gotten the officers badge number or card in order to reach him... Depending on what city u were in, u can go to the police station and file a report and in order to help find the officer that was @ the scene should give u all the information of the person who hit you...

My bet is that she's an older woman. Welcome to Senior Citizen 101. You are beginning to learn the hard way that seniors are as devious and belligerent as anyone on the planet, maybe moreso. She will not contact you. Her insurance company will not contact you. She will pretend as though there is nothing for her or her insurance company to be responsible for. This is typical of her age group. Some of her peers have driven into lakes, pools, bank lobbies, supermarkets, and crowds of people, all claiming that same old time-worn gag "the gas pedal stuck". You need to make the first move, and you need to play hardball. I swear to Christ on a moped. I have seen this so many times it makes me want to vomit. I have even been sitting in my car when some raggedy old biatch bumped into it and she didn't even say a word. Her henpecked husband apologized for her, which as you can imagine meant nothing. If on the off chance that I am wrong and this is not an older woman, which is highly doubtful, you still need to move on it. Get the cops involved. They have a report. Do not under any circumstances let sympathy for this woman on anyone's part affect your right to collect damages. This is exactly why she has insurance.

whats your deductible?
if it is under $500 you may be best off submiting a claim to your insurance company. If she is at fault, it will be in no way chargable against you, so you wont get a suprise apon renewal. But what they will do is have you pay your deductible, and subrogate against her insurance company getting your deductible and any additional money they paid returned to them.-if you have collision coverage this is the job of the claims department, because you pay for the coverage.

how do you know its 300-400 in damages? have you gotten your estimates? get your estimates tomorrow, at least one.
i am quite sure there must have been a police report filed, get your copy indicating that she banged your car.
submit a copy of that report to the claims department from your insurance company, they will find out who she is, and who her insurer is from that.

If you dont have collision coverage on your insurance policy, scrap that idea, your insurance company wont do a thing for you if you dont buy that coverage. so, do the following...

get that police report, it will have her contact info on it. contact her, by phone or mail, if mail, pay $12 for a certified letter, they get signed for and you know she will recive it.
tell her you have one estimate (or mail her that one estimate)
and ask her if she would like to pay out of pocket for the damages rather than you submitting a "at fault" claim against her. Someone will respond to this, they may ask for 2 or 3 estimates, i know its a pain, but if you want it paid for, you have to.

odd chance that there is no response from your call or letter, take your copy of the accident report, it will indicate her insurance company and policy number, call her insurance company's claims department, file a claim against her.
they will confirm this information and get back to you shortly, then they will tell you a body shop to go to, and tell them you will need rental reinbursment while your car is in the shop and they will pay for your rental until work is completed.

those are your options, other than paying for it yourself and seeing her in small claims court. But, try one or all of these things before taking the small claims step.

If you have her insurance details, get in touch with her insurers.
To be honest, if she was taken to hospital, she may well still be in there.
Her insurers will tell you what you need to do!!!

Call your insurance company- it's their job to take car of this for you- that's why you pay them.
