My husband signed the birth certificate nearly 5 years ago for "his" child. He now wants a paternity test because he never was offered one and wants to know the truth. He said the hospital people walked into the room and told him to give his i.d. and sign and never told him that he was waiving his right to a test. Is it too late to get one? What if the child is not his?

Don't you know if the child is his or not?

The paper he signed should say what rights he has or doesn't have. If the paper said he waives rights to a paternity test, then he signed his right away. The lesson is to always read before signing any paper.

If he wants a parternuity test then he would have to pay for one. Why is he asking for one. He would have to pay for the test if it not his. then you would have to find the father which it been so many years ago. If you were lucky to find one. right now my youngest has my ex boyfriend last name and found out that he not the father. It been a year since I went to court to change his last name but it hasn't still. it still the same. He would have to someplace. My health apartment where I went do those. I would call a place like job and family service they could give you a advice.

I don't think it's to late to test, but I think that it maybe to late as far as child support goes, because he did sign the birth certificate. I would suggest going to see a lawyer and see what they say about everything.

Usually before paying child support they will ask him if he wants one.

If he is 'legally' the father then he can get a non-court ordered test between him and the child. If he has reason to believe the child is not his he will need to get into court and he may need a lawyer.

its never too late to get one..

i don't know what the laws are in Indiana but in NY if you are married when you get pregnant it is automatically assumed that your husband is the father so he is legally responsible for the child. until he finds out otherwise.

what you should ask yourself why after all this time is he asking for a paternity test?

You can test at any time. You can buy the kit at Walgreens.com!
