The trial is a sham put forth by a man whom the Bible would characterize as a fool since he doesn't really believe in God and is mocking the concept of the existence of God in his efforts to gain publicity for himself while continuing his pattern of attempting to degrade people of faith.
The real trial that Senator Chambers should be desperately concerned about it this one.

Apparently a convicted criminal in Romania tried the same thing recently, blaming God for the crimes that he had committed. The Romanian authorities said they couldn't summons God because they didn't have his address.

God is out of earthly jurisdiction, He is not lawfully required to show up... any more than you would be required to show up if you are sued by a foreign jurisdiction.
