I recently just got over a really nasty ear infection... I was prescribed 2 pain meds and 1 antibiotic. The 2 pain meds were Naproxen and Tylenol w/codeine. Anyone who has ever taken tylenol w/codeine knows what that stuff is like. Well anyways I was prescribed tylenol 3 with codeine. I get home and take one of them and within 1 hr am feeling drowsy to the point of passing up. Now I have a 1 yr old so that isnt good.
I get a phone call from the pharmacy about 2-3 hrs later stating that they had filled my prescription wrong and it bring it back to give me the right one. Turns out someone there gave me tylenol 4 instead of 3's. Seeing as how this is a big medication error, can I sue this company?

maybe not sue,
BUT i believe you can get some compensation because they neglected to fulfill their duties of been responsible.

they did not follow their protocols of reassuring that any medication given out is correct.

i suggest you maybe seek some extra advise from a lawer

Of course you can sue, but it doesn't mean you'll win. Since you didn't mention that you were injured or incurred other damages due to the mistake, you probably can't recover any financial compensation from the pharmacy. It might be wise to contact the pharmacy and ask what they are doing to prevent this mistake from happening in the future. You say it is a big medication error. However, they prescribed a larger dose of the same medicine on the prescription. Hardly a major, life threatening mistake, but an error nontheless.

You may want to report the pharmacist to the licensing board. Just be thankful that they didn't mistake your medication for something like blood pressure or heart medication. Tylenol #4 is a commonly prescribed painkiller for adults. You took 60 mg of codeine instead of 30 mg. That's the only difference.

No you cannot sue the company but you can report the error to your states board of licensing and regulation so the pharmacist that filled it gets reprimanded.

FYI~ Tylenol3 and Tylenol4, there isnt much difference. they are human,everyone makes mistakes. It's not like you life was in danger.
