We live to geather with my 15yr.old daughter. He is on prop36 and there is a search and seizure, of his doman: we share a room(we stay in same room of corase.) I know any common area, his room where he sleeps , his car ,and so on, or any where he is also can be. BUT can they ,search me? in my own house, or anyplace if I'm with him? NOTE: I am not on or have I ever been on parole nor propbation.

If the police have any reason whatsoever to believe that you may be hiding contraband or any other item on your person that may be associated with an unlawful act, yes, they may search you. Search and seizure normally applies to ones home but they can apply the law any way they see fit! If it were to be an illegal search and seizure, you do have recourse through the legal system.

Yes, you are considered suspicious as well whenever the law is involved. They don't go to law abiding citizens houses and search for drugs. If you are associated with a known criminal you are putting yourself and all you have at risk, and not just by the police.

If you are in the United States the "Patriot Act" gives the police the right to search or seize anyone.

Unless the officer has articulable probable cause, which can be as little as seeing your boyfriend possible passing you something before he is searched, the answer is no. Your person does not come under his probation rules.

they can only search where she stays.
Like her side of the room, or her car.
They may not search you, and also may not make an arrest towards you even if they do find something.

Youally when you are on probation you can't drink alcohol or have any in your premesis.
