i am a avid road biker (bicycle )while riding on pch this past wkend in newport bch waiting at a light to go green in the bicycle lane a benz pulled up behind me wanting to turn right honked at me wanting me to move i did not ,guess he was in a hurry, question is who had the right of way

You did. If it was a true bike lane than the driver was illegally using a bike lane.

Well this really isn't a question of right of way. It's one of lane use. As long as you were in the correct lane, you had the right to be where you were. A bicycle is considered a vehicle and has to obey all of the laws and procedures that a car does. Now if you were waiting in a right turn lane, the driver would be correct.

If you're actually in a designated bike lane, there's no question who has the right of way. It is illegal for a motorized vehicle to travel in (or be parked in) a designated bike lane - even if all they want to do is make a corner.

If you're simply in the right-hand lane (and it isn't designated as either a bike-only lane, or a right-turn only lane), you got to the light first and have the right-of-way. If it happened to be a right-turn only lane, then you should have been more to your left (in the straight through traffic lane), instead of blocking the turners from making the corner.

Bear in mind that the law does not give anyone the right of way; it only tells who must yield it. California law states, "Every person riding a bicycle upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division."

As a cyclist in the state of California, you were not required to move to allow the driver to turn ahead of you.

In my state (Louisiana), cars are NOT allowed in the bike lanes. I'd check your state law first, but I strongly suspect you had the Right-of-Way. Unfortunately, many drivers still don't realize that bicycles have a legal right to use the road.

Don't ever duel with a car - you may be in the right, but you could end up "dead right".

You have the right of way, however the decent thing to do (if possible) would be to scoot left a little to make room for him to go. Golden Rule, ya know?

The only exception is Mack Road, where I purposely hold them back because I'm not heavy enough to trigger the light.

If you were in the bycycle lane, then you are in the right place. The Merc will just have to deal with it.
