do you think that registering with selective service is unconstitutional and why i have a son that will be registering with it in a couple of years and do not want him to be drafted in to the war that will still be going on i know that there is currently no draft but as the war in iraq drags on and when (not if) we go to war with iran the goverment will probably reinstate the draft which is also unconstitutional

It sucks but it's not unconstitutional. Fortunately, very few people who don't sign up to the selective service ever get in any trouble these days. They say you won't get your license here in Minnesota, but guess what. I'm 21 and I still have mine. Even if they did catch you, they would give you a chance to sign up before they did anything.
If he wants to be a martyr, he can avoid signing up and if he gets caught, refuse to sign up, then go to prison or pay a huge fine. Everyone will look and say, "wow. the government is keeping him in prison just because he doesn't want to be drafted? That's BS!" RIOTS EVERYWHERE IN YOUR NAME!

unconstitutional, definition=defying the constitution. the draft has a section all its own in the constitution therefore cannot be deemed unconstitutional. besides the supreme court is probably tired of hearing cases about it. and besides gazing into your crystal ball how do you know were going to war with iran? the government has already stated it has no intention of bringing back the draft anytime soon unless something happens which makes it unavoidable (like another attack or something)
by the way check out article 1 section 8 of our constitution where it refers to calling out a militia.....even in the colonial days people were involuntarily called to war.

Registering for Selective Service and conscription into military service is not unconstitutional. This has been raised many times - usually whenever there is serious risk of or an actual armed conflict. It becomes even more prevelant when an armed conflict becomes unpopular. Regardless of popularity, the constitutionality of the process is not questionable.
The military today is not a conscription based military - and as a result of this the military does not accept all who enlist. New recruits who do not meet acceptable performance are not forced into compliance as was the case during conscription era times. The military prefers to work with those willing to perform as they can train them a lot better and a lot quicker. The military itself does not prefer a conscription based military.
While you have clearly indicated your opposition to armed conflict in which your son may be forced to see action, and many, there are times armed conflict is needed and not avoidable.
It is easy to complain about any administration's foreign policy while you are sitting on the sidelines. When your role is an active one, not one of a spectator on the sideline, decisions have to be made with the info at hand and often the decision has to be made at the current time - and the opportunty for waiting for better or clearer info just does not materalize.
I suggest you comply with the laws and hope for the best.

The draft has been deemed constitutional in several Supremem Court decisions. Opinions do not chnage that. There is small chance of a reinstatement of the Selective Service System at this time or in the near future. It is currently just a database and would take quite some time to set up again.

I don't support the draft, there are too many people being taken away from their families now to probable death for oil in the Middle East as it is. Why would we force people sometime both mother and father to leave their children behind with Grandma and Grandpa, if they are still around, to go fight a war that should have ended by now? If they start sending the Republicans over privileged children to war, and not as pilots, but as ground fighting soldiers, maybe I could believe this war was for something other than greed, but when it was the Republicans in office who took their eye off the reason for us agreeing to the war, Osama Bin Laden, and kept the war about him, instead of Iraq, I gotta believe this war was started with the intention of getting control of the oil in Iraq and anywhere Else in the Middle East, for G.W. Bush and Company from the get go. No, no draft, or as you say, No Mandatory Service, we're paying enough.

First and foremost, there is nothing unconstitutional about the draft. I would suggest you go back and read more carefully.
Second, the draft is not being reinstated, including if we go to war against Iran. It wouldn't be worth the political suicide for every congressman who voted for it.
Third, dodging selective service is a crime. Your son could go to jail, pay fines, WILL lose all federal college grant money, and all sorts of other benefits.

Selective Service is Constitutional. There is no draft. If you believe the press and Bush haters here, the Libs will be in charge for the next 40 years. Do you trust them not to reinstated the draft?

There is nothing in our Constitution that prohibits the draft. When I volunteered for the United States Navy,I took an oath to uphold and defend the Constitution of the United States of America.
It irritates me to no end when I come across a question such as this from an ungrateful American.I went through 3 conflicts to protect your rights and way of life. You're Welcome.
Maybe through outside influence, your son may have developed a sense of worth and hopefully will want to protect this great nation.

The constitutionality of selective service registration and the government's ability to draft persons into service is well-settled by the Supreme Court.
If your son wants to be a man about resisting a draft (not that one will happen), he should RESIST it. That doesn't mean flee to Canada; it means refuse induction and take his lumps.

Wow, are you out of touch. Not only is there no draft as you so eloquently state, he would not necessarily be drafted. And could we get a passage from the Constitution that supports your THEORY?
