As the police have been involved they will investigate the incident and will probalily have taken statements and done some roadside evidence gathering.This may involve taking photographs of the scene and looking at the damage to the cars ,looking for skid marks on the road and of course trying to find any witnesses to the accident and posibly cctv coverage if your lucky. They will check both vechiles for road worthyness and guess the speed of each vechile. They can prosecute if they believe a law was broken eg danerous driving. The police report will be used by the insurance company to decide who is to blame for the accident however sometimes both parties are at fault and an agreement is made like 70/30 or 50/50 and a compromise is agreed between the insurance companies. If either party contests the evidence or the conclutions drawn from it then a court case may result to settle the argument. After all this your insurance company can drag its feet and delay payment and months can go by.

So sorry to hear about your loss.
I can only speak about the insurance I know, in the UK.
On most motor policies, there are liabilities for personal accident, loss of limb, loss of sense and loss of life so you will need to check on the other person's insurer as they all differ.
If you have legal protection, I would advise you to be in touch with them to see if they can help proccess a claim through the courts.
Legal protection itself doesn't pay out for loss of life but can help you sue others.

Sadly it is often cheaper to kill someone than to injure them.
You would have to prove financial loss. If the member of your family had no dependants where is the claim?.
I'm sorry you can not claim for mourning or the loss of a very dearly loved member of your family
If that member had a life insurance policy ro cover her death that is different

i am sorry for your loss;
my brother walked across a street and was struck by an auto that killed him 2 years ago; all that he was entitled to was funeral expenses and any medical bills; we never went after the girl who struck him, believe it or not, even though i am a claim adjuster and my husband is an attorney; our investigation did not conclude that the girl was responsible so we let it go;
in our state for wrongful death, since my brother was single with no dependents, we would not be eligible for no more than the funeral and medical bills; we only had funeral bills since he was on disability and medicade, so there were no medical bills owed;
normally since i am a adjuster, i would not tell you to contact an attorney, but due to your family member being killed, i strongly suggest you contact an attorney who can explain what rights you have;
depending on what state you live in and the laws of your state will govern if you are entitled to more or not; if like in my case that you are not entitled to anything more for your family's loss, blame it on your state government laws;

Usually the legal protection is to cover the legal fees defending a claim.
So...if you were to make a civil claim against that driver their legal fees would be covered
If you thought it just and fair...you could start a civil (sue) claim againts the other driver for negligence. Their insurance would cover their legal fees either from their motor policy or from their house contents insurance (which tends to surprise most!)

OK, THIS is a quesiton you should not be asking on yahoo answers.
You are very likely entitled to policy limits from the other carrier... i hope you havent already settled for less then that.
You may or may not have death benefits on your own policy. For example, here in florida there is a 5k death benefit of policies. Why havent you asked your insurance what yours is?
